What are Accident Benefits Claims?

Updated: Nov 20, 2023

Accident benefits claims in Ontario refer to the benefits that is available to people, including drivers, passengers, and pedestrians, who have been injured in a car accident, regardless of who was at fault for the accident. These benefits are provided through automobile insurance policies, and are intended to cover some of the costs associated with a car accident, such as medical expenses and lost income.

In Ontario, accident benefits claims are governed by the Insurance Act and the Statutory Accident Benefits Schedule (SABS). The SABS sets out the types of benefits that are available, as well as the eligibility requirements and the limits on those benefits.

Some of the benefits that may be available through an accident benefits claim in Ontario include:

  • Medical and rehabilitation expenses: This includes the cost of medical treatment, such as visits to a doctor or physiotherapist, as well as the cost of any equipment or devices that may be needed as a result of the accident.

  • Income replacement benefits: If you are unable to work due to your injuries, you may be eligible for income replacement benefits to help cover your lost income.

  • Non-earner benefits: If you were not working at the time of the accident, you may be eligible for non-earner benefits to help cover the costs of your recovery.

  • Caregiver benefits: If you are unable to care for yourself or your dependents due to your injuries, you may be eligible for caregiver benefits to help cover the cost of hiring someone to provide that care.

  • Death and funeral benefits: If a loved one was killed in a car accident, you may be eligible for death and funeral benefits to help cover the cost of their funeral and other expenses.

If you have been injured in a car accident in Ontario and are seeking accident benefits, it's important to act quickly, as there are strict time limits for making a claim. It's also a good idea to consult with a personal injury lawyer, who can help you navigate the process and ensure that you receive the benefits you are entitled to.
